The case that has as protagonist Dani Alves continues its course in Barcelona. The Brazilian soccer player was arrested on January 20 for being accused of having sexually abused a young woman 23-year-old at the Sutton nightclub on December 30 and is still in the detention center Brian’s 2 where he was transferred by the police of Catalonia.

While waiting for the final definition by the Barcelona Court on whether the historic winger will remain in prison until the date that the trial against him will take place or he will be granted parole, his defense lawyer Christopher Martell he works on aspects that for him are the key that could help the Brazilian to get out of jail.

As explained by the Spanish newspaper The reasonthe defense works on a plan to dismantle what it considers a “narrative distortion” about what happened that morning in the disco where the sexual act without consent for which Alves is accused would have taken place.

in front of new DNA tests provided by the coroner of the Examining Court number 15 of Barcelona, ​​which confirmed that the genetic profile of the semen found inside the victim, as well as on his clothes and on the bathroom floor of the VIP room, belong to the Brazilian, Martell filed an appeal to the City Court after the determination of the Prosecutor’s Office, for the moment, to deny the release of his client.

For the defense attorney, there are elements that support the idea that the sexual act between Alves and the alleged victim was consented. The Spanish medium indicates that, after reviewing the seven hours of recording at night, they establish two minutes apart between the entrance to the bathroom of the player who comes from being part of the roster of the Brazilian team in the last World Cup in Qatar and that of the woman who accuses him.

In this way, for the defense, this would be decisive in establishing that the young woman was not forced or taken into space by Alves himself. Rather, she entered because of his decision. In addition to this, another of the aspects that the defense lawyer seeks to highlight is that, once the sexual relationship between them had ended, the former soccer player for Barcelona and other great teams in Europe came out of the bathroom and went to the bar to order a drink.

According to the defense, this would reinforce the idea that the 39-year-old himself had not committed any crime but had had a consensual meeting with the other party. In this context, it must be remembered that once the young woman withdrew from the bathroom after being abused, she approached her companions – a friend and her cousin – and confessed to them what had happened. The same happened later with one of the security agents of the disco, who was in charge of communicating with the Mossos d’Esquadra (Catalan police).

In this sense, lawyer Martell understands that the investigation initiated by the security forces of Catalonia was “biased” because the videos do not show that the girl has been under a situation of “terror, fear or domination” as indicated by the lawyers of the alleged victim in the case.

In the coming days, the Barcelona Court could establish its final decision on whether or not Dani Alves should remain in prison until the trial date, in which the Brazilian could face a sentence of between 4 and 12 years in prison.
